USER POLICY

ACCEPTANCE OF THIS AGREEMENT

By clicking on the “SIGNUP” option, the participant agrees to the Terms and Conditions, Obligations, Representations, Warranties, and Agreements contained herein. In the event, you are not willing to accept the Agreement, you shall not be authorized or allowed to proceed further to view or use in any manner any content, information, courseware, products and services published,available or provided on online@acriindia.comwhich is owned, maintained and monitored by Avigna Learning Academy LLP.

USER ID AND PASSWORD

By entering into this Agreement, you acknowledge and agree that your user ID and Password is for yourexclusive use only. Use or sharing of your participant account with another user is not permitted and is cause for immediate blocking of your access to the Website, the Services and the Content, the Courseware, and termination of this Agreement.

You agree that you are solely responsible for maintaining the confidentiality of Your Participant Account and for all activities that occur under it. You agree to immediately notify our Customer Support Team at online@acriindia.com if you become aware of or have reason to believe that there is any unauthorized use of Your Participant Account. You also agree to take all reasonable steps to stop such unauthorized use and to cooperate with us in any investigation of such unauthorized uses. ACRI shall not under any circumstances be held liable for any claims related to the use or misuse of Your Participant Account due to the activities of any third party outside of our control or due to your failure to maintain the confidentiality and security of Your Participant Account.

CONTENT AND COURSEWARE

As a part of our services, ACRI shall grant you access to our content, courseware, practice tests, and other information, documents, and data which may be in audio, video, graphic, recorded, photographic, or any machine-readable format in relation to the specific certification training course you have registered for.

USAGE OF PERSONAL INFORMATION OF PARTICIPANTS

ACRI reserves the right to feature your picture in any photos, videos, or other promotional material used by us. Further, ACRI may use your personal information to inform you about other certification training courses offered by us. However, ACRI shall not distribute or share your personal information with any third party marketing database or disclose your personal information to any third party except on a case-to- case basis after proper verification of such third party and after taking your confirmation or,-if required under any applicable law.

TERM AND TERMINATION

This Agreement will become effective upon your acceptance of the terms of this Agreement by your clicking on the “I ACCEPT” button and, subject to the terms and conditions of this Agreement, will remain in effect till you maintain a current, fully paid up online Participant Account, or until terminated by us, whichever is earlier.

ACRI reserves the right to terminate this Agreement and block your access to the Content and Courseware with immediate effect by sending a written notice through email to you to this effect (“Immediate Termination Date”), if such termination is made as a result of your misrepresentation, default, misconduct, or breach of your obligations related to or under this Agreement. On the occurrence of any Event of Default, ACRI shall be authorized to exercise all the rights and remedies under this Agreement or applicable Law or available in equity to seek indemnification for any Loss or Claim resulting from any such Event of Default.

SHARING YOUR PERSONAL INFORMATION

If you have purchased a course, ACRI may ask you for your feedback, and display your testimony, your public information, photos or videos on our website or on our social media channels such as Facebook, YouTube or Twitter. You should be aware that your publicly identifiable or displayed information could be used by third parties to send you unsolicited promotional, unsolicited messages. ACRIis not responsible for your personal information which you have chosen to display and any unsolicited promotional messages that you may receive from third parties.

NON-COMMERCIAL USE BY MEMBERS

The ACRI Services are for the personal use of Members only and may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by ACRI. Illegal and/or unauthorized use of the ACRI Services, including collecting usernames and/or e-mail addresses of Members by electronic or other means for the purpose of sending unsolicited e-mail or unauthorized framing of or linking to the ACRI Website is prohibited. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from Member profiles without notice and may result in termination of Membership privileges. Appropriate legal action will be taken for any illegal or unauthorized use of the ACRI Services.

PROPRIETARY RIGHTS IN CONTENT ON ACRI

  • The ACRI Services contain Content of ACRI which is protected by copyright, trademark, patent, trade secret and other laws, and ACRI owns and retains all rights in the ACRI Content and the ACRI Services.
  • The ACRI Services contain Content of Users and other ACRI licensors. You may not copy, modify, translate, publish, broadcast, transmit, distribute, perform, display, or sell any content appearing on or through the ACRI Services.

COPYRIGHT POLICY

You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to others without obtaining the prior written consent of the owner of such proprietary rights. It is the policy of ACRI to terminate Membership privileges of any Member who repeatedly infringes the copyright rights of others upon receipt of proper notification to ACRI by the copyright owner or the copyright owner’s legal agent. Without limiting the foregoing, if you believe that your work has been copied and posted on the ACRI Services in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information:

  • an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
  • a description of the copyrighted work that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the ACRI Services;
  • your address, telephone number, and e-mail address;
  • a written statement by you that you have, in good faith, a belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

ADDITIONAL INFORMATION

Our Services are primarily designed to help you share information with the world. Most of the information you provide to us is information you are asking us to make public. This includes not only the messages and notes you write about content and forum posts, but also any other place where you are able to type. The metadata provided with ALISON, such as when you are certified, shows up in your public profile page. Our default is almost always to make the information you provide public but we generally give you settings (https://alison.com/myaccount) to make the information more private if you want. Your public information is broadly and instantly disseminated. For example, your public information is searchable by many search engines. Users should be careful about all information that will be made public on ALISON (such as your public profile, comments and testimonials), not just posts. Under the ALISON terms and conditions, all registration information submitted must be truthful and accurate. ALISON offers an educational service, hence it is very important you enter only valid information, then set your profile to private if you wish. Once made private, the link will still show on search engine results for a few weeks, but when clicked the account information will no longer be visible.

ACRI is not responsible for any incorrect or inaccurate Content posted on the ACRI Website or in connection with the ACRI Services, whether caused by Users of the ACRI Services or by any of the equipment or programming associated with or utilized in the ACRI Services. ACRI does not guarantee the efficacy of its learning content & material. Other provisions may be added to qualify the company’s liability to the presentation of effective quality education and training material. Profiles created and posted by Members on the ACRI Website may contain links to other websites. ACRI is not responsible for the Content, accuracy or opinions expressed on such websites, and such websites are in no way investigated, monitored or checked for accuracy or completeness by ACRI. Inclusion of any linked website on the ACRI Services does not imply approval or endorsement of the linked website by ACRI. When you access these third-party sites, you do so at your own risk. ACRI takes no responsibility for third party advertisements which are posted on this ACRI

Website or through the ACRI Services, nor does it take any responsibility for the goods or services provided by its advertisers. ACRI is not responsible for the conduct, whether online or offline, of any User of the ACRI Services. ACRI assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, any User or Member communication. ACRI is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer

equipment, software, failure of any e-mail or players due to technical problems or traffic congestion on the Internet or on any of the ACRI Services or combination thereof, including any injury or damage to Users or to any person’s computer related to or resulting from participation or downloading materials in connection with the ACRI Services. Under no circumstances shall ACRI be responsible for any loss or damage, including personal injury or death, resulting from use of the ACRI Services, attendance at a ACRI event, from any Content posted on or through the ACRI Services, or from the conduct of any Users of the ACRI Services, whether online or offline. The ACRI Services are provided “AS-IS” and as available and ACRI expressly disclaims any warranty of fitness for a particular purpose or non-infringement. ACRI cannot guarantee and does not promise any specific results from use of the ACRI Services.

LIMITATION ON LIABILITY

IN NO EVENT SHALL ACRI BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ACRI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, ACRI’S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO ACRI FOR THE ACRI SERVICES DURING THE TERM OF MEMBERSHIP.

ACRI does not authorize any third party to accept payments on behalf of ACRI for any ACRI Services. ACRIis not liable for any payments made to a third party by an ACRI Member. ACRI cannot provide a refund or exchange on the purchase of a PDF (Portable Document Format) certificate.

DISPUTES

If there is any dispute about or involving the ACRI Services, you agree that the dispute shall be governed by the laws of the Republic of Ireland, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in Ireland. Either ACRI or you may demand that any dispute between ACRI and you about or involving the ACRI Services must be settled by arbitration utilizing the dispute resolution procedures of the American Arbitration Association (AAA) in Los Angeles, California, USA, provided that the foregoing shall not prevent ACRI from seeking injunctive relief in a court of competent jurisdiction.

USE OF COOKIES

ACRI uses cookies to store visitors’ preferences and to record session information, for purposes including ensuring that visitors are not repeatedly offered the same advertisements and to customize newsletter, advertising, and Web page content based on browser type and user profile information. We do not link the information we store in cookies to any personally identifiable information you submit while on our site. Online Assessments

This how-to- guide will provide steps on accessing assessments and how to view results.

ACCESS ASSESSMENTS

The ASSESSMENTS will be located within a content area labeled Assessments, which is accessed from the course menu.

Step 1. From the Course Menu locate and click the Assessments link.

Step 2. The Assessments content area page will display

Step 3. Click on the Title of the Assessment you want to take.

Step 4. Click Begin to view assessment questions and begin taking the exam.

Assessment Instructions

The student will be give three attempts to take the exam.

  • Timed Test: The test will have a time limit of up to 30 minutes @ 1 minute/question.
  • Multiple Attempts: A test can be taken three times.
  • Timer Setting: This test can be saved and submitted when time expires.
  • Students must complete the assessment and submit it. Students may not exit the assessment and continue working on it at a later date.

ACCESS ASSESSMENT RESULTS

Test results include a Score. Upon submitting anassessment, you are given the option to view the grade.

COURSE EXTENSIONS

In some cases in which unforeseen events prevent a student from completing a course during the prescribed time period, ACRI can extend the session for an extra time period. To do so, a request for an extension must be sent to the Program Administrator at online@acriindia.combefore the session is scheduled to end. Extensions cannot be granted after the end date of the course session.

AGREEMENT

This Agreement is accepted upon your use of the ACRI Website or any of the ACRI Services and is further affirmed by you becoming a Member. This Agreement constitutes the entire agreement between you and ACRI regarding the use of the ACRI Services. The failure of ACRI to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.
